These Terms & Conditions ("Terms") govern your use of the Jaivakam website and your purchase of products or enquiry about farm experiences through this site. By browsing this website, placing an order, or submitting an enquiry, you agree to these Terms and our Privacy Policy.

If you do not agree, please do not use this website.

1. Who we are

Jaivakam Agro is a partnership firm based in Kerala, India. We handle distribution, marketing, and sales of Jaivakam products — online through this website and through other approved channels.

Our products are grown, harvested, or crafted at Jaivakam Farm and partner growers in Kerala. When you place an order on this website, your contract is with Jaivakam Agro.

References to "Jaivakam", "we", "us", or "our" in these Terms mean Jaivakam Agro unless the context requires otherwise.

2. What these Terms cover

These Terms apply to:

Product orders placed through our online cart and checkout
Farm visit and experience enquiries submitted through our website (e.g. on the Experiences page)
General use of this website, including browsing products, reading content, and submitting messages to us

Shipping, delivery, returns, and refunds for product orders are also described in detail on our Shipping & Returns page, which forms part of your agreement with us.

3. Eligibility

You must be at least 18 years of age and capable of entering a binding contract under Indian law to place an order or submit a binding enquiry.

By using this website, you confirm that the information you provide is accurate and that you are authorised to use any payment method you offer.

We currently sell and deliver products within India only. Experience enquiries are open to individuals, families, schools, and small groups as described on our Experiences page.

4. Products

Descriptions and natural variation

We describe our products — Ayurvedic herbs, organic produce, honey, spices, essential oils, personal care items, sacred botanicals, and nursery saplings — as accurately as we can. Product photographs are representative; natural and handmade items may vary slightly in colour, size, shape, weight, or appearance.

Wellness and Ayurvedic disclaimer

Jaivakam products are intended for general wellness, culinary, or personal care use. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Ayurvedic and herbal products are traditional food or wellness supplements. Always read product labels, consult a qualified healthcare practitioner before use if you are pregnant, nursing, taking medication, or have a medical condition, and discontinue use if you experience an adverse reaction.

Certifications

Where applicable, our products are backed by recognised certifications (such as FSSAI registration and organic or AYUSH-related credentials). Details are available on our Awards & Certifications page. Certifications apply to specific products or processes as indicated — not necessarily to every item in our catalogue.

Availability

All products are subject to availability. We may limit quantities, discontinue items, or substitute unavailable products only with your prior consent.

5. Placing an order

How ordering works

Add products to your cart and proceed to checkout.
Provide your name, phone number, shipping address, and optional email.
Submit your order — this constitutes an offer to purchase at the prices shown.
We will contact you on WhatsApp with UPI payment instructions.
Your order is confirmed for dispatch only after we verify payment.

Order acceptance is at our discretion. We may refuse or cancel an order (for example, due to stock unavailability, pricing errors, suspected fraud, or delivery restrictions to your pincode) and will notify you via WhatsApp or phone where possible.

Your responsibilities

You are responsible for providing a correct shipping address, reachable phone number, and accurate order details. We are not liable for failed or delayed delivery caused by incorrect information you submit.

6. Pricing and payment

Prices

All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise on the product page or at checkout.

We reserve the right to change prices, delivery fees, and product availability at any time. The price charged is the price displayed at checkout when you submit your order, subject to correction of obvious errors.

Delivery fees are shown at checkout before you confirm your order.

Payment method

All online orders are prepaid via UPI following WhatsApp payment instructions sent after order placement. We do not accept cash-on-delivery through this website.

Payment must be completed before we dispatch your order. If payment is not received within a reasonable time, we may cancel the order without notice.

We do not store your full UPI or banking credentials on this website. Payment is handled directly between you and us via UPI.

7. Promotions and discount codes

From time to time, we or our marketing partners may offer promotional discount codes applied at checkout.

Unless stated otherwise on the offer:

Discount codes must be entered at checkout and cannot be applied retroactively
Only one promotional discount may apply per order
Codes are non-transferable, have no cash value, and cannot be sold or exchanged
Discounts apply to eligible products and order subtotals as defined in the specific offer
We may modify, suspend, or withdraw any promotion at any time without prior notice
Promotional offers cannot be combined unless explicitly stated

If a discount code is invalid, expired, or used in breach of its terms, we may cancel the associated order or charge the full price before dispatch.

8. Delivery, returns, and refunds

Delivery timelines, packaging, tracking, return eligibility, and refund processing are set out on our Shipping & Returns page.

By placing an order, you agree to those policies. In summary:

We dispatch within 2 business days of payment confirmation
Standard delivery across India typically takes 4–7 business days after dispatch
Because many of our products are natural and perishable, returns are not accepted after dispatch, except for eligible on-arrival issues reported within 48 hours

9. Order cancellation by Jaivakam

We reserve the right to refuse, suspend, or cancel any order at our sole discretion, including but not limited to cases of:

Product unavailability or sourcing issues
Pricing or listing errors
Inability to deliver to your pincode
Non-payment or failed payment verification
Suspected fraudulent or abusive activity
Breach of these Terms

If we cancel a paid order before dispatch, we will refund the amount paid via UPI to your original payment account within a reasonable timeframe.

10. Farm visits and experience enquiries

Our Experiences page describes farm walks, beekeeping demos, harvest experiences, workshops, and related activities at Jaivakam Farm.

Enquiries are not confirmed bookings. When you submit an experience enquiry through our website:

You are requesting information or availability — not making a paid reservation
We will respond via phone, WhatsApp, or email to discuss dates, group size, pricing, and logistics
Any visit is confirmed only when we explicitly agree terms with you in writing or via WhatsApp, including date, time, fees (if any), and safety requirements
We reserve the right to decline, reschedule, or cancel experiences due to weather, farm operations, safety concerns, or capacity limits

Participation in farm activities is at your own risk. You must follow instructions from our staff, respect farm property, and disclose any health conditions or allergies relevant to outdoor or food-related activities.

Children must be accompanied by a responsible adult unless otherwise agreed in writing.

11. Website use

You agree to use this website lawfully and not to:

Attempt unauthorised access to our systems, admin areas, or other users' data
Upload or transmit malware, spam, or harmful content through enquiry forms
Scrape, copy, or reproduce site content at scale without our written permission
Misrepresent your identity or affiliation
Use the site for any purpose that violates applicable Indian law

We may restrict or terminate access to the website for conduct that we reasonably believe violates these Terms.

12. Intellectual property

All content on this website — including text, product descriptions, logos, photography, video, and design — is owned by Jaivakam Agro or our licensors unless otherwise credited.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent, except for personal, non-commercial use such as sharing links to our pages.

The Jaivakam name and branding may not be used in a way that suggests endorsement or partnership without our permission.

13. Privacy

Our collection and use of personal data — including order details, enquiry information, and website usage — is described in our Privacy Policy.

By using this website, you acknowledge that you have read and understood our Privacy Policy.

14. Limitation of liability

To the maximum extent permitted by applicable law:

Jaivakam Agro is not liable for indirect, incidental, special, or consequential damages, including loss of profit, data, or goodwill, arising from your use of this website or our products
Our total liability for any claim relating to a specific order is limited to the amount you paid for that order
We are not responsible for delays or failures caused by events outside our reasonable control (see Section 15)

Nothing in these Terms limits liability that cannot be excluded under Indian law, including liability for death or personal injury caused by negligence where such limitation is prohibited.

Product-specific safety guidance on labels and on this website must be followed. We are not liable for misuse, improper storage, or use contrary to label instructions.

15. Force majeure

We are not liable for failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, epidemics, government restrictions, courier disruptions, strikes, power or internet outages, or farm conditions affecting harvest or dispatch.

We will use reasonable efforts to notify affected customers and resume normal operations as soon as practicable.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision.

Continued use of the website or placement of orders after changes are published constitutes acceptance of the updated Terms. We encourage you to review this page periodically.

Material changes affecting existing orders will be handled in good faith and in accordance with applicable law.

17. Governing law and disputes

These Terms are governed by the laws of India.

Any dispute arising from or relating to these Terms, your use of this website, or any order placed through it shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

We encourage you to contact us first on WhatsApp to resolve any concern before pursuing formal proceedings.

18. General

Entire agreement: These Terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and Jaivakam Agro regarding online orders and website use.
Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
No waiver: Our failure to enforce any right or provision does not waive that right.
Assignment: We may assign our rights under these Terms; you may not assign yours without our consent.
